Terms and conditions for bespoke furniture services.

Introduction

These terms and conditions govern the provision of bespoke furniture services by Collectionqualit. By commissioning furniture from us, you agree to these terms.

Commission Process

Bespoke furniture is made to order based on your specific requirements. The process begins with initial discussions to understand your needs, followed by design development, approval, and construction.

Each commission is unique, and the design and making process is tailored to the specific piece and its intended context.

Design and Approval

Design proposals are presented for your approval before construction begins. Once approved, the design serves as the basis for making. Changes to the approved design may affect the cost and completion schedule.

Technical drawings and material samples are provided as part of the design development process. These documents form part of the commission agreement.

Materials

Materials are selected in consultation with you, with consideration given to the design requirements, intended use, and aesthetic preferences. Material selection may affect the cost of the piece.

Timber is a natural material and may exhibit variations in colour, grain, and figure. These characteristics are part of the material's character and are not considered defects.

Payment Terms

Payment terms are agreed upon at the time of commission and specified in the commission agreement. Typically, a deposit of 50% is required to commence work, with the balance due upon completion or according to an agreed schedule.

Payment may be made by bank transfer, cheque, or other agreed methods. All prices are stated in British Pounds Sterling unless otherwise agreed.

If payment is not received by the agreed date, we reserve the right to suspend work until payment is received. Late payment may result in additional charges.

Ownership of the furniture remains with Collectionqualit until full payment has been received.

Construction and Completion

Construction proceeds according to the approved design and technical drawings. The making process allows for adjustments based on the material's characteristics, within the parameters of the approved design.

For built-in furniture or pieces requiring installation, installation is carried out on site. The piece is inspected to ensure it meets the design intent and functions as intended.

Variations and Changes

If you request changes to the approved design after construction has begun, we will discuss the implications for cost and schedule. Changes may require additional design work and may affect the completion date.

Ownership and Intellectual Property

Designs and technical drawings remain the intellectual property of Collectionqualit unless otherwise agreed. The completed furniture becomes your property upon full payment.

Delivery and Installation

Delivery dates are estimates and are not guaranteed. Delays may occur due to material availability, complexity of the work, or circumstances beyond our control.

For built-in furniture, installation is included in the commission. For freestanding pieces, delivery may be arranged separately. Delivery and installation costs are specified in the commission agreement.

You are responsible for ensuring that the installation site is ready and accessible. Any delays or additional work required due to site conditions may result in additional charges.

Warranty and Defects

We warrant that our work will be free from defects in materials and workmanship for a period of one year from the date of completion. This warranty covers defects that arise under normal use and proper care.

Natural variations in wood, such as colour, grain, and figure, are not considered defects. Wood is a natural material and may move slightly in response to changes in humidity and temperature.

If a defect is discovered, please contact us immediately. We will inspect the piece and, if a defect is confirmed, we will remedy it at no additional cost to you.

This warranty does not cover damage resulting from misuse, neglect, improper care, or modifications made without our consent.

Limitation of Liability

Our liability is limited to the value of the commission. We are not liable for indirect or consequential losses arising from the use of the furniture, including but not limited to loss of profits, business interruption, or damage to other property.

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded or limited by law.

Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, labour disputes, or material shortages.

Disputes and Governing Law

Any disputes will be resolved through discussion and negotiation in good faith. If a resolution cannot be reached, disputes will be subject to the jurisdiction of the courts of England and Wales.

These terms are governed by English law. If any provision of these terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
